1. Acceptance of Terms
By booking an appointment, using our services, or accessing our website at whatsupdawgtx.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you ("Client") and What's Up Dawg! ("we," "us," or "our").
2. Services
What's Up Dawg! provides the following pet care services in Sherman, TX:
Dawgy Day Out – Supervised daytime dog daycare including structured play and socialization.
Dawgy Night Inn – Overnight boarding and lodging for dogs of all sizes.
Suds & Snuggles Spa – Premium bath, brush-out, and grooming services.
Service availability, hours, and offerings are subject to change at our discretion. We reserve the right to modify, suspend, or discontinue any service at any time with or without notice.
3. Reservations and Cancellations
3.1 Booking
All appointments and reservations are made through our booking portal (Gingr App at whatsupdawg.portal.gingrapp.com) using invite code 470337. Reservations are not confirmed until you receive a confirmation from us.
3.2 Cancellations
We ask that cancellations be made at least 24 hours in advance for daycare and grooming services and at least 48 hours in advance for overnight lodging. Late cancellations or no-shows may be subject to a cancellation fee. We reserve the right to establish and update cancellation fees, which will be communicated at the time of booking or via our booking portal.
3.3 Holiday and Peak Periods
Extended cancellation notice may be required during holidays and peak periods. Any additional requirements will be communicated at the time of booking.
4. Health and Vaccination Requirements
For the safety of all pets in our care, we require the following:
All dogs must be current on core vaccinations, including Rabies, Distemper/Parvo (DHPP), and Bordetella (kennel cough). Proof of vaccination from a licensed veterinarian is required.
Dogs must be on a regular flea and tick prevention program.
Dogs must be free of contagious illness or parasites at the time of drop-off.
Females in heat are not permitted in group play settings.
We reserve the right to request veterinary records at any time and to refuse service if vaccination or health requirements are not met.
5. Pet Behavior and Temperament
5.1 Temperament Assessment
We reserve the right to conduct a temperament assessment for any dog prior to or upon arrival. Dogs exhibiting signs of severe anxiety, aggression toward people or other dogs, or other behaviors that pose a risk to staff, other pets, or the facility may be refused service or separated from group play.
5.2 Right to Refuse Service
We reserve the right to refuse, suspend, or terminate services for any dog at any time if we determine that the dog's behavior, health, or temperament presents a risk. In such cases, the Client will be notified immediately and asked to arrange pickup.
6. Client Responsibilities
By using our services, you represent and warrant that:
You are the legal owner of the pet or have been authorized by the owner to make decisions regarding the pet's care.
All information provided about your pet (breed, age, health history, vaccination records, behavioral history) is accurate and complete.
Your pet is in good health and free of any contagious conditions at the time of drop-off.
You will notify us immediately of any changes to your pet's health, medications, or behavioral concerns.
You will be reachable by phone during your pet's stay or will provide an authorized emergency contact who can make decisions regarding your pet's care.
7. Emergency Veterinary Care
In the event of a medical emergency, we will make every reasonable effort to contact you or your designated emergency contact. If we are unable to reach you and your pet requires immediate veterinary attention, we reserve the right to transport your pet to the nearest available veterinary clinic and authorize emergency care on your behalf. All costs associated with emergency veterinary care are the sole responsibility of the Client.
8. Liability Limitation
8.1 General Limitation
While we take every precaution to provide a safe and caring environment, you acknowledge that the care of animals involves inherent risks. What's Up Dawg!, its owners, employees, and agents shall not be liable for any injury, illness, death, loss, or damage to your pet arising from circumstances beyond our reasonable control, including but not limited to acts of nature, escape, or interactions between animals during supervised group play.
8.2 Property Damage
You agree to be financially responsible for any property damage caused by your pet to our facility, equipment, or to other animals or persons while in our care.
8.3 Limitation of Damages
To the maximum extent permitted by applicable law, our total liability to you for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
9. Payment
Payment is due at the time services are rendered unless otherwise agreed in writing. We accept the payment methods listed in our booking portal. Prices are subject to change without notice. You are responsible for all charges associated with your pet's stay, including any additional services provided.
10. Personal Property
We are not responsible for lost, damaged, or destroyed personal items brought in with your pet, including toys, beds, leashes, collars, or other belongings. We recommend labeling all items and limiting what is brought, as items may be damaged or soiled during your pet's stay.
11. Media Release
From time to time, we may photograph or video record pets in our care for use on our website, social media platforms, or promotional materials. By using our services, you grant What's Up Dawg! a non-exclusive, royalty-free license to use photos or videos of your pet for these purposes. If you do not wish for your pet to appear in our content, please notify us in writing.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in a court of competent jurisdiction in Grayson County, Texas.
